I talk in USCIS standards. They mentioned in last weekly report that they are compliant till 7/1/2007 but actually that was 6/29/2007.

I don't understand why you are picking up on facts and faults on other post.What mirage is saying is true.I know 3 families stuck up in this GC process...all true cases.
There are some lucky people who have bought old labor substitution ;)who came to US in 2004 and got their GC's cleared and are very :D.
Some really who have come here to study...living in US for past 10 years genuine appliers are really stuck in this.They have all applied their labor and got them cleared only dec 2006.
people who are interested can send those letters if not ignore the thread.
If you are EB2 good for you...Its not that easy to change jobs having families..and when you are satisfied with the employer ,why would they change.
Everyone here want GC to stay in this country.And we all are here to find solutions thru IV - active participation is better.
Pani's letter is not that bad...if you dont like alter what you want to express and send it.People can write what they are facing only.

If I were OP, I will at least show my letter for some kind of legal review before sending. After all who would like to make condition bad to worse?

HR 5882 has the answer for the FIFO problem.
USCIS is pretty good with approving cased based on PD for 3/4th of the year and in the last quarter they for the "Hail mary" play and DOS gives a wide PD range during the last quarter for USCIS to play. Apart from recapturing wasted visa's HR 5882 also has an automatic recapture provision to avoid any future visa wastage. If this provision is in place then UCSIS/DOS will not be in a position to playing the "some how use up visa by sep 31" card to approve random cases.
Rather than focusing on HR 5882 many are still pondering about LUD's and sill day dreaming. The demand for visa's is much higher than the supply of visa's, it doesn't matter what new spillover policy USCIS adopts, it can only provide incremental improvements. For a quantum improvment in the situation we need a legislation and HR 5882 is the best option we have now.

Are there enough recaptured visas to cover all?
Agreed that with more visa numbers, and no potential threat to wastage of visa numbers, USCIS has no incentive nor tricky cards to play to justify their random approval bursts.....but will that be enough to prevent them from doing so, just because they can? I mean this is USCIS we are talking about.....Even with laws/memos/rules already in place, they are violating them left and right....
Whats to say that they won't try to reassure people that they don't have to worry about out of order processing because
- there are enough visa numbers for all.
- Though people may see delays, they will eventually all get their GCs
- Its faster and easier if they just grab the first box that is on the top of the pile, and approve cases from there rather than spending very limited resources they have to try to dig thru the boxes to find the cases with oldest PD.
- It will just be a minor inconveneince to the applicants...Their waiting times would drastically reduce from several years to only couple of years.
Would that be acceptable to us then?
If they say every body will be current, with free job movement due to EADs, and every body will get GC within 2-3 years absolutely. PERIOD. Just no gaurantees of FIFO processing. --- Would that be acceptable to us then?

What spillover for EB3 you are talking about? Based on how they interpreted the spillover law last year, EB3-I can't get any spillover until EB2-I and EB3-ROW is current and thats decade away.
I am just trying to get the facts. I am not against EB3-I as I myself is EB3-I and waiting for my turn since last 7 years.

I Agree with you, EB3 I will never ever be current unless there is a resolution or releaf passed by Mr Change (Obama) or his lobby, there is no light beyond this tunnel until we see some releaf which does not look getting this year atleast and may be another couple of years.
Predictions are good to just hear and watch and here predictions are like lovely dreams which will never come true unless untill any big chnage is taken place, and the only person who i have hope with to do something for EB3 I is President Obama.
But he is kind of busy with other important issues and our issue is not that important for him reason may be we are not his vote bank and will get to the curve of getting the GC when we are very close to our graves.
This is really furstating and freinds sorry to express my frustration here on this forum but i am done and just look at my PD Dec 2001 for the past 1 year i hear from my lawyer you are just the next badge and should be current in the next bulletin.
I think we should live everything aside and just do our best at work thats what i am doing and thank god for getting our bread and butter in this economy.

1)I disagree with the bill, why should legal employment immigration pay for policing the border. Why only H1 and L1s? Why not other temporary and permanent immigration visas

It just does not add up that they cannot employ 50% locals/residents. I would go further and make it really difficult for someone to do this unless they can really prove the need (like in case of EB1)

This is the first receipt i am noticing for an application received on July 2nd at 7:55AM and signed by R. Williams.
All other recipts so far were either received at 9 AM or 10:25 Am or so (july 2nd, 3rd, 5th etc) but none of them were at 7:55 AM.

This is going to be the biggest problem because in US, we have a foundation for debt based economy (SSN, credit history, Credit score, credit ratings etc.) If you default the payment, you will have an effect and there will be an impact on future credit applications. There is nothing of this sort in India and the politicians will not allow such things to be setup as well. So essentially back to my point. Banks who lend money are at bigger risk of loosing it. There is nothing that they can do to report on consumer's default or fraud for that matter.
Now per say consumer dump the property or bank attaches it for non payment of loan amount, Bank will be stuck with properties worth 1/4th for those crores that they loaned to people, maintenance will cost them more to prepare it for sale.
In any account, there is a big problem ahead there.

Hello everyone,
This is what I have done today. Called up BOTH my Senators and My local Congressperson. First asked them the name of the Person in-charge of immigration. Then Faxed him/her a ONE page description of what has happened and Urged them to take action.
Please do the same with your local Lawmakers. I believe that if Enough people call and fax them, they WILL do something eventually. It's a NUMBERS GAME and only if enough people contact them will they budge.
Please contact your lawmakers with a Nicely typed letter explaining your current situation and what the USCIS has done.

One thing for sure USCIS do likes April fools day a lot as this the date they usually pick when the retrogress. This proves that a fool named DOS in love with April fools day.:)
I don't know if anybody has noticed it but the dates for EB-2 for VB October 2007 was April 1, 2004 and for VB October 2008 is April 1, 2003. That is a retrogression of 1 year - not good. :mad:

All is not lost however, there is still a chance for the amendment to be offered in one of the forthcoming budget bills, including a likely omnibus at years end.
