Hi Friends,

My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

Congresswoman Zoe Logfren & & senator John Cornyn are supporters of legal immigration, they have always come forward to help the legal immigrant community. I guess it is high time people from California & Texas write & call to their offices and complaint about USCIS/DOS action of not releazing and statistics on I-485 applications pending invarious categories. We are blind folded by these Visa bulletins with no idea of what there for EB-3, EB-2 India, China etc. we don't know how many people are ahead of us what to do next. All this will resolve it USCIS/DOS tells us how many applications they have pending from which country and which category....For that we need to call these lawmakers..

Keep new approved H1 and all related documents with you for POE, also EVL.

I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.

I just entered even after new USCIS memo.

Guys ,
Here is my situation. greatly aprecite if you could give some suggestions.

I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...

1. How should the new employer file H1b so that I can join at my wish after oct 2008...??

2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. So we're really talking about less than .2% of all births as being this huge problem that suddenly justifies overturning the 14th Amendment.

I am currently in the US on H1B and want to pursue higher studies. Can someone please let me know the supporting documents that are required for COS.
Do I need my original
1. Transcripts/Marksheets
2. Experience/Relieving Letters
3. Tax Returns
4. Bank Statements for 6 months

I am asking this because i dont have these documents with me right now and I want to apply for a Change of Status immediately. I know that the above are all required to file for a F1 visa

Would appreciate a response.

Hello,

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.

I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...
