My law school roommate and long time friend Henry Olsen is the vice president of the conservative think tank the American Enterprise Institute. He's written an essay for the National Review entitled "The Way of the Whigs" and it talks about the danger the GOP faces in terms of long term survival. This might seem strange given the recent polling problems the Democrats have experienced, but Henry writes that there are long term forces at work that Republicans need to heed. While travelling on Advance Parole, which job title should I mention to the immigration officer. The Job Titile is different on H1-B and Permanent Residency application. Thanks.

My friend is in a wierd situation.
His employer applied for H1b under premium processing in USA, the application was sent back as some information was missing under 221g. The employer has submitted the application again. Does anybody know how long will it take for the application to be processes as it was initially filed under premium processing?
Also, since now the H1b approval is not confirmed, He is under OPT and it expires in Aug 2011. Can he apply for STEM extention as his employer is e verified. so incase his h1b is not approved he can still continue to work under OPT. Is it possible to get the STEM extention while his H1b is still under processing? Need you urgent advise. Please help!!

Thats not an issue looks like. When you go for FP, just ask them to see if your name is correct in the system with you A number. Thats more important thatn the spelling on notice.

The California Service Center (CSC) will hold a tour of its facility in Laguna Niguel, California, for HR personnel involved with filing immigration cases for their workers. The tour is on March 11, 2010. It will begin at 12:15PM and end at 1:00PM. From 1:00PM to 2:30PM, CSC officers will meet with the visitors and answer questions. The topics will include best practices for filing and advice HR professionals should give their foreign workers. I have a question about filling out this section: PART 4, Processing Information. I am the employer and applying for a current H-1B holder (currently with another company) to transfer to my company AND extend his stay. He is currently here in the US.
Some people tell me I don't have to fill this section in, however the instructions say "if beneficiary...is outside the usa OR a requested extension of stay...cannot be granted, state US consulate or inspection facility you want notified".
What address should I put/consulate should I use (H-1B holder is from India).
Questions: 1) do i have to fill in all 1.a,b, c, and d?
2) does it matter if i check off consulate, pre-flight inspection, or port of entry?
3) if beneficiary doesn't have a fixed address in India anymore can I leave it blank?

I filed for AOS during July 2007 fiasco. I filed I-140 (Company A)concurrently with I-485. This concurrently filed I-140 got denied. I had another approved I-140 (Company B)from a different employer. My I-485 is still pending. Is there anyway to use AC-21 to reuse old approved I-140 for this pending I-485? Thanks for your valuable inputs.

Hi,
I am GC holder & right now I am living out side USA with my husbad whom I am married for more than 8 yrs. I have 2 kids, they are US citizen. I visit my parents (US Citizen) every year to US for couple of months & come back. In past my husband tried for US visitor visa few times but he was denied. Is there any way I can apply for my husnad a non immigrant VISA from US for a visit? As we would not like to migrate to US but just to visit there. Is there any way or I have to apply for him immigrant visa only & wait for 5-7 yrs.?
Please guide.

My wife is planning to travel overseas for 3 months and return on AP. Her status is AoS(dependent) as she quit working on H1 a few months ago. Any experience using AP for such long stays outside the country? Please share your experiences.

bigboy007: As long as you have filled the form given by ASC officer and she has endorsed your FP notice, You are fine. ASC officer was right, single finger print will cover both of your applications. Just relax, I see no issues.

1)I am on H1b visa and currently i am on bench. My 140 is approved and my H1b is expiring on sep30 ,2009. I got rfe for h1b extension asking for client letter.
Should i convert to h4 or do h1b transfer if i could be able to get someone to transfer it.
2) Also if I go to h4 visa will my green card processing with priority date remain same if i go back to same employer and ask them to file my h1b again after i get a project. Or they again have to start the process again even with same employer. Also what if i go with different employer.
3. If I apply for H4 visa now and in mean time i get a project before sep 30 2009, then what do I need to do. can i just ask my employer to again file h1b extension.
4) SO if I do h1b transfer or go on h4 what are the pros and cons.
Please let me know ASAP.
