Dear all:

May I ask what I should do in the following situation?

I hold F1 visa and my new job starts on Sept 1. The int'l student office of my current university mistakenly set my OPT start date on May 6. My OPT has been approved and EAD card arrived.

That is, I will have 120-plus "unemployment" days accumulated by early August, which will then violate the "90-day unemployment rule" of OPT.

I am under tremendous pressure and really want to hear your opinions.

My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

As Birth Certificate is part of Initial evidence, 2 secondary evidence affidavits for incomplete/incorrect entries is always good for peace of mind. Search for numerous threads on Birth Certificates last month for affidavit format, who can provide etc.

Below is a link I came across which is easy set up, formatted already for users to input their personal information and off it goes to the Congress to educate them about the importance of travel industry and meetings market. Yes for extensions - Auto revalidation only from contiguous countries - Canada, Mexico and some islands.

There are several other requirements - take some effort and google it !

Whatever you call it, you are really always applying for a new EAD. There is no such thing as renewing an existing EAD. The I-765 form that you complete will ask about any prior EADs that you had. If you do not have details, please put as close to the facts as possible. If you still have a CIS receipt number, definitely include that so CIS can look up the details.

When you use EAD it does not matter if the company got any money under the TARP program or not.

You should not even bring this to the attention to your HR. Go and use EAD as if the company is just any other company, make sure that the job is "same / similar" and get a lawyer for using AC21 portability.

After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

yes she can renew and you can also renew without any issues.

Hi,
I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Processtimes.jsp?SeviceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all?
