Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

You are already counted in the quota. So it is just transfer. But for transfer need recent paystubs. Consult a lawyer how to handle this. Definitly you no need to wait for April 1 st quota for new H1B.

I also received RFE. It was related to TB chest X-ray. In '07 doctor said, it is not requited but USCIS feels other way.

IV Members,
My PERM Labor application was certified on Jan 24th 2011. Attorney received an email that the case has been certified and will send the approval notice shortly.
Its been close to 4 weeks and have not received the hard copy. can someone share their experiences about the time line to receive hard copy.

My H1 stamping has expired. I have traveled using AP before. Just wanted to know if anyone traveled back with AP via Brussels?
Email I received from Belgium consulate just says "Indian nationals do not need transit visa". I am sure it means they do not bother about H1/AP as long as you have legal entry for the destination. Just wanted to re-check.

I am in 6th year of my H1B. It is expiring in Aug 2011.
Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.
Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

Hi Gurus,
Request your help on my query. I am on H1B with an I 797 valid upto 29-Jan-2011 and dependants have stamped H4 visas valid upto 29-Jan-2011. My company is in the process of applying for my H1B extension (this will be my second extension and i have currently completed 4 yrs 9 months in US).
My dependants are planning to travel to India at the end of this month and plan to return back by end of Nov. Will they face any issues during their return at POE ?
Will there be any complications with our visa extensions ?
Appreciate your response at the earliest.

There is no issue what-so-ever using AP to enter US. I don't know why you are mixing H1 with AP. Both are different. AP is just a travel Document that can be used to travel abroad and return to US. Does not matter if you have a H1 or not.

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Beginning March 1, 2010, Mexico will require U.S. citizens to have valid passports when traveling to Mexico. Legal residents of the U.S. must have their green cards or other documents demonstrating legal status in the U.S.
This new rule by Mexican authorities shouldn't change travel habits, because it has been the law in the U.S. since June 2009 that U.S. travelers returning to this country from Mexico must show their passports.

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)

My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?

Here how it goes, one of my friends visa date got current in June 2007. He applied for his I-140 and I-485. For some strange and unknown reason to me , he did not file I-485 for his wife who is on H4 and thought that he will file later once he gets his receipt. Now he has his receipt and was getting ready to file the i-485 for his wife it dawned on him that dates are retrogressed again and the lawyer told him that he cannot file I-485 for his wife. Now the situation is that he has to wait until the dates get current, but what if they dont and he gets his green and his wife dont which will automatically make his wife out of status and she has to go back and you all know how hard it is to sponsor on green card.
My question is that, is this the true statement that he cannot file I-485 for his wife due to retrogression since his wife is dependent and should be able to file since his dates were current?
If this statement is true what are the available options
