The Supreme Court issued its decision in the Arizona business license/e-Verification law of 2007 and by a 5-3 margin has upheld the law. This is the law that allows the state to revoke business licenses for firms knowingly hiring unauthorized workers and also mandating all employers use E-Verify. you do not have to apply for COS, if she wants she can get h4 stamped when she travels, but is moot anyways as she plans to use EAD anyways nullyfying her H4.

Where to send the communication for AC21 to Texas Service Center? Has anybody used the email pilot?

My background:
1. Got Ph.D three years ago
2. worked in a hospital as a PI and postdoc training for three years
3. worked as research associate at University of Houston last year
4. working as research assistant professor(Faculty) at UH
5. Four foreign grants including national grant
6. several awards including the First Prize awards in foreign provincial health field
7. Published more than 20 papers, only two are SCI (one is PNAS published this year without citation so far), others are foreign language papers have more than 40 citations.
Now I am preparing files and will apply as EB-1b.
can you tell me the best points to claim?
I will tell you any progress in the coming days. Thanks forum friends.

Hi,
My PD is 2005 and my I-485 was denied on the ground of my birth certificate and I got more proof from where I was born and submitted to USCIS and it was accepted in August 2009 and since then it has been more than a year and there is no update in the online status update for my I-485 application.
Lot of my friends from Late 2005 and early 2006 got the GC's last couple of months. I have requested my Lawyer to make a AILA inquiry? What else can I do at this point?

Hi
i am in a small problem and it would be great if someone could help me out.
i came in us on f1 visa in jan2008 and i completed my mba in dec 2010. my opt expired on 31st march 2010. but before my SEVIS could expire i transfered my SEVIES to new college for summer term. now my visa is for 5 years ending on jan 2013. i know as long as i stay in US i am maintaining my status. but now i need to go home for few days. So how is it going to wrok for me? Do i need to go for new visa stamping or can i come back on same visa ? if i need to get new visa can i get it done in US before going home ? What are my option and what are my chances of coming back?

if you have EAD, alien # is same as A# on the EAD card. otherwise i think you should fill NA or none (check instructions page,for blank, what you need to fill).

My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

I am in the process of applying for the green card but as the labor department was delayed to send the paperwork by status became out of status, my lawyer suggested me to go back to my country apply for H1B visa and come back. That is why I want to apply for H1B visa . My lawyer tells me that there is no way I can get an approval if my company doesnt show tax return documents for the last 2 years. Is it true or there is another way or documentation which could be used in order to apply for the visa? My boss doesnt want to show the tax returns but accepts to show a bank account and different type of paperwork such as franchise agreements or certificates.
Can you please let me know if my lawyer suggests me the righ way if not which woudl be the best way to continue my green card process and get a result as soon as possible.

Can we pursue to have an amendment like SKIL bill or something in Economy stimulus bill? The amendment can be relevant to economy stimulus since it will give competitive advantage to america thereby stimulating the economy. (Something like AC21 made into law in 2000 to increase american competitiveness to stimulate economy)
Also, this way, there is a chance that legal immigration issues will be discussed separately from illegal immigration issues.
The economy stimulus bill is being currently discussed in House and soon will be in Senate where lot of amendments will be voted on. The bill seems to have bi-partisan support as well. We can hope this will be one more amendment to the bill!

My father in law mistakenly entered the wrong date for his date of arrival in the U.S. (entered data in Indian style) on his citizenship application form. The number of days out of the country was also wrong.
Is there a way to rectify this mistake and inform USCIS about this ? Is there a form, or can we simply write a letter regarding the errors to the USCIS office ?
What would be the best way to address this issue ?

I have valid SSN and B1 visa. My employer wants to me travel to US after getting confirmation on my project from US. My employer is willing to do a change of status while I will be in US.
1. Is it feasible or any process which US Immigration supports? Could anyone pls help me with any USICS link which details about the same i.e 'Change of Status'
2. Is there any risks involved in it provided the change of status is a legal process?

hello,
Unfortunately a person with a pending form I-130 is not eligible to receive a work authorization. I-130 itself does not give you the legal authority to USCIS to issue a work permit. It is possible to get a work authorization if such a person has a pending I-485 (Adjustment of status) or is in other valid immigration status that would allow him / her to get work authorization.
Hope this helps?
