I applied for I140 on January and receipt date is Jan 12 2007, I upgraded to PP during last days of June, and the receipt date for it was July 2nd and today i was checking the status, the status is showing a receipt date of July 5th, i called customer service center they say that receipt date is July 5th and this is not a premium case. I understand that they have temporarily suspended PP for 140, but even though my request for upgrade to PP was rejected, the receipt date should be still Jan 12 2007 or will they change it to latest date when request for PP upgrade was denied, anyone facing this issue?

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

Hi,
I am on H1b visa and it is expiring on Sep 2010. I heard that we need to apply for renewal 3 months before the expiry date,(i.e,June). I am planning to transfer my H1 to another employer. If I do so, will my H1 be automatically renewed during the transfer process? Also, If I transfer my H1 and go out of the country, do I need to get my visa stamping re-done when I come back to the country...

Hi guys,
I am adding my wife's AOS application to my own pending AOS application. Because of whatever reasons we couldn't file our apps together earlier.
I notice that I need to give my wife's Alien registration no (ARN) at a couple of places in the application package, such as in the I-485 form, G-325A form, and at the back of the photographs.
Needless to say, my wife does not have an ARN. I was allocated an ARN when my I-140 got approved. Since she is just a derivative beneficiary, she does not have an ARN yet.
So what should I do about these columns in the form. Should I leave them blank, or should I fill them up with my own ARN.

Your help on the matter is appreciated. I am EB3-I. I filed for I-485 in July-07. I have been working on H1. Now I am going to switch to EAD by AC21. My new job has same job title and job duties. They have another condition for job. I will have to have a Masters in 8 years of starting my job.Their basic requirement is still Bachelors but Masters condition is kind of extra condition. My question is does this give me any trouble for my GC process because of Masters condition.Another question is will I be able to switch to EB2 based on this.

Hello,

I have a difficult situation , i have a H1B expiring in 5 Days and also ending the 6 yr period. My company is filing a H1B to L1A conversion application from US in premium processing
1. Is it legal to stay until L1A is approved? for duration of 2 weeks until L1 Premium processing is done
2. In L1A is rejected, would it be legal to travel citing the rejection of L1 petition
Please help me with any insight you may have

1) Do my spouse need to take Affidavit of Support docs(form I 864), my 485 is employment based and not family based(I am the primary applicant).

Sorry , please ignore the phrase 'fiscal cap', actually it should be annual H1B cap for that particular year.
