    Hi Gurus,

    I wanted to know if I can work for H-1B with my current company which holds my H-1B and work outside with another company on EAD. Is there a chance that I may loose my H-1B status if I work with EAD.

    Please let me know,

    When you start using EAD you will lose H1 status. You can do multiple jobs on ead but not on H1

    Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

    Hi Guys,

    I used to work for company �a� which was a part of the bigger company �A�. There was another company �b� which was a part of the bigger company �B�.

    Now both companies A and B made a joint venture (JV) and made company �c� joining company �a� and �b�.

    Company A has 25% stake and company B has 75% stake in JV(Company "c"). The new formed company "c" has �new name�, all employees filed �new employment applications� and have �offered a new employment� with the new company �c�

    Now my question is as this company �c� is totally �new�, can I convert my EB3 case to EB2 and use company �a� experience and file for EB2 with company �c�

    Democrats in Congress are discovering what it's like to live in the worst of all possible worlds. They are condemned for selling out to President Bush and condemned for failing to make compromises aimed at getting things done.

    Democrats complain that this is unfair, and, in some sense, it is. But who said that politics was fair?

    Over the short run, Democratic congressional leaders can count on little support from their party's presidential candidates, particularly Barack Obama and John Edwards. Both have decided their best way of going after front-runner Hillary Clinton-- who has been in Washington since her husband's election as president in 1992 -- is to criticize politics as usual.

    At this weekend's Democratic fundraising dinner in Des Moines, Obama and Edwards not only attacked Bush fiercely but also issued broadsides against the larger status quo.

    When Obama assailed "the same old Washington textbook campaigns" and declared that he was "sick and tired of Democrats thinking that the only way to look tough on national security is by talking and acting and voting like George Bush Republicans," he was aiming at Clinton. But Obama was echoing what many in his party have been saying about their congressional leadership.

    And when Edwards said that "Washington is awash with corporate money, with lobbyists who pass it out, with politicians who ask for it," he was criticizing a system in which his own party is implicated.

    It makes sense for Democratic presidential candidates to distance themselves from the party's Washington wing. A poll released last week by the Pew Research Center found that 54 percent of Americans disapprove of the performance of Democratic congressional leaders, an increase in dissatisfaction of 18 points since February. Among Democrats, disapproval of their own leaders rose from 16 percent in February to 35 percent now; in the same period, disapproval among independents rose from 41 percent to 56 percent.

    Democrats in Congress say that their achievements of a minimum-wage increase, lobbying reform, improvements in the student loan program and last week's override of Bush's veto of a $23 billion water-projects bill are being overlooked -- and that Bush and his congressional allies have systematically blocked even bipartisan efforts to produce further results.

    For example: The increases in financing for the State Children's Health Insurance Program passed after Democrats made a slew of concessions to Republicans to win broad GOP support. But in the House, Democrats were short of the votes needed to override the president's veto, so the proposal languishes.

    Rep. David Obey (D-Wis.), chairman of the Appropriations Committee, notes that he has bargained productively with Republicans and that his budget bills have secured dozens of their votes. But the president seems intent on a budget confrontation.

    In a letter to Bush on Saturday, House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid tried to underscore the president's role in the stalemate by calling for a "dialogue" to settle budget differences that "have never been so great that we cannot reach agreement on a spending plan that meets the needs of the American people."

    They went on: "Key to this dialogue, however, is some willingness on your part to actually find common ground. Thus far, we have seen only a hard line drawn and a demand that we send only legislation that reflects your cuts to critical priorities of the American people."

    Pelosi and Reid have a point, and they want Bush to get the blame for a budget impasse. But Bush seems to have decided that if he can't raise his own dismal approval ratings, he will drag the Democrats down with him. So far, that is what's happening.

    Yet the budget is just one of the Democrats' problems. Their own partisans are furious that they have not been able to force a change in Bush's Iraq policy. In the Pew survey, 47 percent said the Democrats had not gone "far enough" in challenging Bush on Iraq. Many in the rank and file are also angry that the Democratic-led Senate let through the nomination of Michael Mukasey as attorney general even though he declined to classify waterboarding as a form of torture.

    Congressional Democrats are caught between two contradictory desires. One part of the electorate wants them to be practical dealmakers, another wants them to live up to the standard Obama set in the peroration of his Iowa speech when he praised those who "stood up . . . when it was risky, stood up when it was hard, stood up when it wasn't popular." Is there a handbook somewhere on how to be a courageous dealmaker? Pelosi and Reid would love to read it.

    Hi Guys,


    I am masters student from USA. Last june i graduated masters and started my OPT. My OPT ends 2009 feb. In this April 2008, i have applied for H1 and just few weeks back i came to know that my H1b got approved. Its validity date will be from October 2008. I want to go to visa stamping in canada or mexico in july or august or september ie before october(h1b valid date) only. Is this possible.
    Will i get any problems while returning back to USA from canada as my h1 validity date is from october. Is it possible that even if i get visa stamped, can i go to india in september like that as we are having some family function over there and planning in advance.It would be great if you can clarify my doubts.

    I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.


    Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.

    Please suggest.

    For the second time this month, a local South Carolina Republican Party committee is expected to decide soon whether to formally scold Sen. Lindsey Graham (R-S.C.) for supporting the Senate's now-stalled immigration overhaul proposal, putting the once-popular lawmaker on the defensive and upping the ante for a potential 2008 primary challenger.

    "The frustration [with Graham] is real," said one state Republican source, who added that the state's large conservative base is "just searching for someone" to challenge Graham in next year's primary.

    The Spartanburg County Republican Party is expected to vote Aug. 23 on a resolution officially rebuking Graham for supporting his chamber's immigration bill. Criticism of the reform package, which was shelved last month after failing to gather the 60 votes necessary to cut off debate in the Senate, has raged throughout the country and particularly in states such as South Carolina, where AM talk-radio hosts have bloodied the Senate proposal and said it tries to reward those who have broken the law.

    Rick Beltram, chairman of the Spartanburg County Republican Party, said he doubts a resolution criticizing Graham's stance on immigration would pass by a wide margin. But should the measure come up for a vote, Beltram already has developed a game plan to manage what likely will be an angry lot.

    "This being as explosive as it is, we would ask for a secret ballot so 30 or 40 Rep. Ron Paul [R-Texas] people yelling in the background wouldn't have an influence on the election," Beltram said.

    Last week, the Greenville County Republican Party passed a resolution censuring Graham for continuing to "adamantly support legalization of illegal immigrants." In addition to immigration, local party officials reprimanded Graham for supporting campaign finance reform and participating two years ago in the "Gang of 14," a bipartisan Senate group that negotiated a compromise on controversial federal judicial nominations.

    The resolution also criticized Graham's recent statements before the National Council of La Raza, which were captured by cable news networks.

    "We are not going to run people down. We are not going to scapegoat people. We are going to tell the bigots to shut up and we're going to get this right," Graham told the crowd.

    Samuel Harms, the Greenville GOP chairman whose group adopted a resolution in 2001 "opposing any legalization of illegal immigration," said Graham's speech to La Raza was the "straw that broke the camel's back." He added that the resolution was "about informing people that Lindsey Graham called the good people of Greenville bigots and that we need to be told to shut up."

    A successful censure vote next week in Spartanburg may signal a widening opportunity for a potential Graham challenger next year. So far, Graham faces only token primary opposition and last month he dodged a potential bullet when popular state Treasurer Thomas Ravenel (R), who was considering a run, was arrested for allegedly distributing cocaine.

    Democrats have yet to find a challenger to the first-term Senator.

    After recapturing some of the love lost during his Gang of 14 days, a GOP source said Graham's recent bruising for supporting the immigration bill may convince some conservative party activists that an opportunity is again at hand. Also, Graham's support of tanking presidential candidate Sen. John McCain's (R-Ariz.) campaign, the source said, is not helping his cause.

    "The immigration issue reignited the ember," the source said.

    Still, with Graham sitting on $4 million in the bank, potential primary challengers face a steep uphill battle contending with an incumbent who may have twice that total squirrelled away before the year's end. Lt. Gov. Andr� Bauer (R), frequently said to be mulling a run, told Roll Call last week that he has not ruled out the possibility of challenging Graham.

    "I would never say never," Bauer said. "But I don't have any plans to run against him."

    But Bauer does plan to appear at the Aug. 23 meeting of the Spartanburg County GOP.

    Katon Dawson, chairman of the South Carolina Republican Party, said that while it's unusual for party activists to go to such extremes with federal officeholders, the immigration issue has struck a nerve with the party's base.

    "You can't bluff it, you can't beat around the bush about it, it's there and it's real," he said. "Lindsey has a different philosophy on immigration and there's no question it's hurting him."

    For now, Graham appears to be resting on his conservative laurels and betting that the controversy will pass. Graham currently is out of the country, his campaign said Friday, but will return to the state to campaign later this month.

    "Lindsey Graham is a strong conservative voice in the U.S. Senate with a lifetime conservative rating of 91," according to a statement provided by spokesman Scott Farmer. "He will seek re-election based on his conservative voting record and willingness to tackle the hard problems facing our nation."

    Whit Ayers, a Republican pollster, said immigration undoubtedly is a challenging issue, but one that plays to Graham's strengths. Even more, despite the current controversy, Ayers said voters ultimately respect lawmakers who take principled positions.

    "Sen. Graham is a remarkedly adept politician who will be able to be very persuasive about the reasons why he's done the things he's done," Ayers said. "I don't think we would expect our politicians to be in lock step on every single issue that comes up."

    He added: "There's no question that Lindsey Graham is right where most Republican voters in South Carolina are on God, guns, gays and taxes."

    Hi Friends!
    This is my first post here, and I take this opportunity to say hello to everyone here. Having browsed through this forum, I can see that this definitely is the finest immigration forum around.
    My wife, who is a US citizen, is filing for my immigration tomorrow, and along with it, she is also filing for my Adjustment of Status (And Advance Parole as well as Employment authorization). She would file it at the Chicago dropbox tomorrow. I am on a B2 visa here.
    I would like to know how long would it take, or how long does it averagely take these days, for the AP and EAD to be processed in a case like mine.
    I saw another thread about processing time of AP, but that was for AP renewal. In my case, it would be a fresh AP and EAD.

    Hi,

    If a H1B visa holder is in US, i know it is possible to transfer H1B to a different comapny in US. But can anyone help me understand if the same is possible if the person having the H1B visa is in india currently?

    Using H1B visa, the person has worked in US for first 3 years. Now the person has applied for H1B extension and still the petition papers have not yet come. After applying extension the person has gone back to India. The person's current company is hesitating to send him back to US.

    Question
    After getting the petition papers, can one transfer H1B visa to a different company staying in india itself and them come to US via new comapany?
